Texas Car Inspections in 2026: What Houston Buyers Need
The short answer
Since January 1, 2025, most Texas drivers don't need a state safety inspection before registering a car. House Bill 3297 ended the safety inspection program for non-commercial vehicles, according to the Texas Department of Public Safety. That isn't the whole story for Houston buyers, though. Harris, Fort Bend, Montgomery, Brazoria and Galveston counties still require a passing emissions inspection for gas-powered vehicles before registration, and every non-commercial vehicle still pays a $7.50 Inspection Program Replacement Fee when it's registered. If you're buying a car to register in the Houston area, emissions is the inspection you still have to plan for.
I'm Steven Wilson, Sales and Social Media & Marketing Manager at Kramer Autoplex. For this post I read the DPS announcement, TxDMV's December 2024 news release, and TxDMV's registration and title bulletin on HB 3297. This is general information, not legal advice. Your county tax office has the final word on your registration.
What changed in 2025
DPS summarizes it this way: as of January 1, 2025, non-commercial vehicles no longer need a vehicle safety inspection before registration. A few details buyers ask me about:
- The fee didn't go away. DPS says all non-commercial vehicles are still subject to a $7.50 inspection program replacement fee, paid when you register with TxDMV. DPS also says the fee isn't an increase in your registration cost; it replaces revenue the old inspection used to provide.
- Brand-new cars pay a two-year fee. New vehicles (current or preceding model year) bought in Texas and never registered in Texas or another state pay an initial $16.75 fee that covers two years.
- Commercial vehicles still get safety inspections. DPS says all commercial vehicles in every county still need a passing safety inspection, and they're exempt from the replacement fee.
What still applies in the Houston area: emissions
DPS is clear that emissions tests are different from safety inspections. If your vehicle is registered in an emissions county, it still needs one. DPS lists the counties, and the TxDMV release lists 17 of them. In the Houston region those are Brazoria, Fort Bend, Galveston, Harris and Montgomery. DPS also says Bexar County will be added in 2026.
According to TxDMV's bulletin on HB 3297, customers in emissions counties must get a passing emissions inspection for previously registered gas-powered vehicles and pay a $2.75 emissions inspection fee before registration or renewal. DPS says the price of the emissions test itself varies by vehicle and county, and vehicles that were already exempt, including electric-only vehicles, are still exempt.
What this means when you buy
Here's how I'd think about it as a buyer in Houston or East Texas:
- Ask whether the car has a current passing emissions test if it'll be registered in an emissions county. If it hasn't, you'll need one before you can register or renew.
- Don't treat "no safety inspection" as "nothing to check." The state stopped inspecting things like lights, wipers and tires on most cars, but DPS reminds drivers that driving without working safety equipment is still against the law. On a used car, that's a reason to get an independent inspection before you buy, not a reason to skip one.
- Where you live matters more than where you buy. Emissions rules follow the county where the vehicle is registered. If you live outside the emissions counties, the TxDMV bulletin says title applicants in non-emissions counties self-certify the VIN on the updated Form 130-U.
- Budget for the fees at registration. The replacement fee and, in emissions counties, the emissions fee are added at registration. For the bigger costs, like sales tax and title fees, see Texas car tax, title, and registration fees explained.
If you're buying from a dealer, ask who handles the title and registration paperwork, and what you'll pay at signing. For private sales, read our guide to the documents you need to buy a car in Texas.

Frequently asked questions
Do I need a state inspection to register a used car in Houston?
You don't need a safety inspection for a non-commercial vehicle anymore. If the car is gas-powered and registered in Harris County or another emissions county, you still need a passing emissions inspection.
Why am I still paying an inspection fee?
DPS says HB 3297 kept a $7.50 inspection program replacement fee for non-commercial vehicles, collected when you register. It replaces revenue that safety inspections used to bring in.
Do electric cars need an emissions test in Texas?
DPS says vehicles that were exempt from emissions inspections, including electric-only vehicles, are still exempt.
How I can help
If you're shopping for a car, I help people in Houston and East Texas get financed with good credit, bad credit, thin credit, or no credit. I shop each application across a wide lender network, including lenders that work with damaged or limited credit. Same-day answers on where you stand are typical, but they're not a guarantee of approval. Free delivery is available anywhere in Texas, and nationwide delivery is available outside Texas.
Bottom line
Texas dropped safety inspections for most cars in 2025, but Houston-area buyers still deal with emissions testing and a small replacement fee at registration. Ask about the emissions test before you buy, and get an independent inspection on any used car anyway.
